All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the client's needs in respect of provision of the Company's stated services/products, in accordance with and subject to, prevailing law of Nigeria. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Xavat Pay may revise these Terms of services from time to time. The changes will not be retroactive, and the most current update of the Terms will govern our relationship with you. We will try to notify you for example via our service notification or send an email to the email associated with your account.

Who may use the service

You may use the Services only if you are ready to agree to terms of service that governs our relationship with users and others who interact with Xavat Pay.

Reservation of rights

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our Web site. Approved organizations may hyperlink to our Web site as follows:

- No use of Xavat Pay logo or other artwork will be allowed for linking absent a trademark license agreement.

Serving charges and billing

We do our best to keep Xavat Pay safe, but we also need your help to keep Xavat Pay safe, through the following required commitments from you:

- You will not upload viruses or other malicious code.

- You will not make unauthorized commercial communications (such as spam) on Xavat Pay.

- You will not collect users' content or information, or otherwise access Xavat Pay using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission.

- You will not engage in unlawful multi-level marketing on Xavat Pay.

- You will not engage in profile or account impersonation or soliciting user login information or access an account of other Xavat Pay Users.

- You will not use Xavat Pay to perform anything dubious, unlawful, misleading, malicious, or discriminatory.

- You will not provide any of your private information such as Bank details, certificate etc to anyone on Xavat Pay.

- You will not do anything that could disable, overburden, or vitiate the proper working or appearance of Xavat Pay, such as a denial of service attack or interference with page rendering or other Xavat Pay functionality.

- You will not facilitate or encourage any violations of this Statement or our policies.

Registration and account security

We require you to provide us with your real identity in other to serve you better. The commitments you make to us with respect to registration and maintaining the security of your account are:

- You will not provide any false personal information on Xavat Pay, or create an account for anyone other than yourself without proper permission from Xavat Pay.

- You will not create more than one personal account.

- If we disable/block your account, you will not create another one without our rightful permission from Xavat Pay. You will keep your contact information accurate, secure and up-to-date.

- You will not share your password for anyone else to access your account, or do anything else that might jeopardize the security of your account.

- You will not transfer your account to anyone without first getting our rightful permission.

License

Unless otherwise stated, Xavat Pay and/or it's licensors own the intellectual property rights for all material on Xavat Pay. All intellectual property rights are reserved. You may view and/or print pages from Xavat Pay for your own personal use subject to restrictions set in these terms and conditions.

You must not:

- Republish material from Xavat Pay

- Sell, rent or sub-license material from Xavat Pay

- Reproduce, duplicate or copy material from Xavat Pay

- Redistribute content from Xavat Pay (unless content is specifically made for redistribution).

Reseller Upgrade

The charge for Reseller Upgrade is ₦3,000.

You can only request for this upgrade if your wallet balance is up to ₦3,000.

Purchasing and Delivery of Airtime, Data, Cable TV, Electricity and other Services

Xavat Pay will, when indicated as functional by System Status, send each service request to one of our gateways for delivery to the relevant network, providing no error is displayed to suggest that this will not be done. Xavat Pay guarantees that under these circumstances all services are DELIVERED. However, delivery is the responsibility of third party networks and services, including the receiving device itself, and cannot be guaranteed. Delivery confirmations may only be available at certain times.

Disclaimer

To the maximum extent permitted by applicable law, we exclude all representations, warranties and conditions relating to our website and the use of this website (including, without limitation, any warranties implied by law in respect of satisfactory quality, fitness for purpose and/or the use of reasonable care and skill). Nothing in this disclaimer will:

- Xavat Pay itself is not a bank and doesn't hold or claim to hold a banking license.

- Limit or exclude our or your liability for death or personal injury resulting from negligence;

- Limit or exclude our or your liability for fraud or fraudulent misrepresentation;

- Limit any of our or your liabilities in any way that is not permitted under applicable law; or Exclude any of our or your liabilities that may not be excluded under applicable law.

- The limitations and exclusions of liability set out in this Section and elsewhere in this disclaimer:
(a) are subject to the preceding paragraph; and
(b) govern all liabilities arising under the disclaimer or in relation to the subject matter of this disclaimer, including liabilities arising in contract, in tort (including negligence) and for breach of statutory duty.

You Also Agree That:

- We can change our services at any time without notice.

- We can place advertising, which supports our services, within applications, on web pages, on mobile devices, and more.

- We will temporarily block your Xavat Pay account once we observe suspicious activities on your account.

- We will request your BVN and valid National ID in cases of suspicious activities and you must provide the correct details to us within 24 hours for verification.

- We will permanently block your Xavat Pay account if you use fake details as your name or on your profile in general.

- We will permanently debit your wallet balance if you use fake details as your name or on your profile in general.

- We will permanently debit your wallet balance and permanently block your Xavat Pay account if you engage in fraudulent activities.

- We will temporarily limit your account for 30 minutes if 5 failed login attempts are made in your account (This is a security measure taken to safeguard your account).

- We will temporarily block your account from performing transactions for 30 minutes if 4 incorrect transaction code is provided (This is a security measure taken to safeguard your account).
